The High Court has issued conservatory orders stopping the arrest and prosecution of several Nairobi Hospital directors and officials in a case linked to the facility’s governance and management.
In its ruling, the court directed that State agencies shall not arrest, detain, summon, charge, or prosecute the petitioners over any matters relating to the governance, management, or affairs of Nairobi Hospital until the case is fully heard and determined.
“A conservatory order be and is hereby issued restraining the 1st, 2nd, and 3rd Respondents from summoning, arresting, detaining, charging, prosecuting, or continuing the prosecution of any of the 1st–6th Petitioners/Applicants,” Justice Bahati Mwamuye ruled.
The court further ordered that no action should be taken that would alter the hospital’s directorship, membership, administration, or operational status during the pendency of the case.
It stated that the restraining orders will remain in force until April 10, 2026, unless varied or lifted by the court. The petitioners were also directed to serve all relevant parties and file proof of service.
The matter had earlier been scheduled for mention on April 9, 2026, but will now proceed on April 14, 2026, for further directions after compliance with the High Court orders.
The decision comes amid ongoing criminal proceedings against several senior officials of the hospital, who face charges including procuring registration by false pretences and failure to comply with company filing requirements. The accused persons have denied all the charges.
The dispute continues to highlight ongoing tensions over the governance and management of the medical facility as legal proceedings continue.
