Busia Governor Paul Otuoma is facing a lawsuit after a man sought KSh 100 million in damages, claiming the county boss assaulted him during an official event and later intimidated him.
The petition, filed at the Milimani High Court, alleges that the incident occurred on March 6, 2026, at Bukri Market in Funyula Constituency during a county event. Yusuf Suleiman Hamisi, a 31-year-old boda boda rider, is said to have been attacked while waiting in line for the distribution of certified maize seeds.
According to court documents, the governor allegedly kicked Hamisi in the groin without provocation. The incident reportedly happened in public and was captured on video, which later circulated widely on social media.
Through his lawyer Danstan Omari, Hamisi claims he faced obstruction when seeking medical attention at Sioport and Ruambo Sub-County hospitals, allegedly linked to the governor’s office.
The petition further states that after reporting the matter to Sioport Police Station, the victim received threats. Unknown individuals reportedly visited his home demanding he withdraw the complaint, and he was allegedly briefly abducted before escaping and going into hiding.
The lawsuit argues that the alleged assault violated Hamisi’s constitutional rights, including the right to dignity, personal security, equality, and fair administrative action.
It also claims the actions breach leadership and integrity standards outlined in Chapter Six of the Constitution and the Leadership and Integrity Act.
Among other reliefs, the petitioner seeks a court declaration that Governor Otuoma is unfit to hold public office, an order compelling investigative agencies to act, and directions for the Busia County Assembly to initiate impeachment proceedings under Article 181.
The petition also requests protection, medical care for the victim, and proper investigations into the incident.
