Prime Cabinet Secretary Musalia Mudavadi has renewed his call for a review of the Constitution of Kenya through a national referendum.
Speaking during the County Assemblies Forum Annual General Meeting at the Kenyatta International Convention Centre, where he accompanied President William Ruto, Mudavadi argued that the time is ripe for Kenyans to revisit and harmonise sections of the 2010 Constitution that continue to generate debate.
Anchoring the Ward Development Fund
Mudavadi emphasized the need to entrench the Ward Development Fund in the Constitution to eliminate ongoing disputes over its legality and structure. According to him, formal constitutional recognition would provide clarity and stability.
He noted that he first raised the issue on December 26 last year, describing it as a potential “constitutional moment” for the country.
Proposed Areas for Amendment
Mudavadi referenced recommendations contained in the National Dialogue Committee (NADCO) report as matters that may require constitutional anchoring. These include:
Enforcing the One-Third Gender Rule through clear statute
Creation of the Office of the Prime Minister
Establishment of the Official Leader of the Opposition
Formalizing the Ward Development Fund
Mixed Reactions
The proposal has drawn varied responses. Former Chief Justice David Maraga and sections of civil society have criticized the timing and intent behind the push, suggesting it may carry political undertones.
On the other hand, leaders such as Moses Kuria, Tom Ojienda, Kimani Ichung'wah, and political analyst Mutahi Ngunyi have supported the idea.
They argue that conducting a referendum alongside the next General Election could efficiently address constitutional ambiguities while reducing additional costs.

The matter had quieted earlier this year but now returns to the national spotlight as the country edges closer to the next election cycle.
Whether Mudavadi’s renewed push will gain broader political consensus—or spark another round of heated debate—remains to be seen.
